At Beyond Vacations , we understand that you care how your personal information is handled and we appreciate your trust that we will do so carefully and sensibly and in compliance with the Australian Privacy Principles of the Privacy Act 1988.
This statement of our privacy policy has been prepared because we recognise that our clients may have concerns about their privacy and confidentiality whilst dealing with us.
PURPOSE OF THE POLICY
This policy statement outlines how Beyond Vacations collects personal or sensitive information in its dealings with clients and other members of the public, including users of our website, and how we manage that information.
INFORMATION WE COLLECT
We will regularly collect personal information including your name, address, phone number, fax number or email address, and credit card details, as well as the details of your assets and financial affairs that you provide us in connection with our provision of services to you.
Other information that may be collected from time to time if reasonably necessary includes your health condition and medical history, passport number, concession card number, driver’s license number and tax file number.
The personal information collected will be mainly held by us on electronic storage media, although paper records may also exist. Paper records will be held in secure premises, and electronic records will be accessible only by authorised personnel holding a valid password.
REASON FOR COLLECTION
This information will routinely be collected in order to assist us in providing products or services or fulfilling enquiries or requests.
The information collected is to identify the individual, to assess the suitability of and to compose the products and services that Beyond Vacations is to provide, and where requested to assess an application for credit and to monitor such credit facility provided and where necessary to assist in the recovery of any debt.
In connection with these purposes Beyond Vacations may disclose personal information to trade insurers, other suppliers, credit reporting agencies, debt collecting agencies, cheque guarantee providers, other organisations involved in Beyond Vacations ‘s business practices, an individual’s representative and as required by law.
If you provide us with personal information specifically for a particular purpose (a primary purpose) then you must expect that Beyond Vacations may also use and disclose that information for any of the aforementioned other purposes (a secondary purpose). In addition to the aforementioned purposes, a permitted secondary purpose will be any other purpose that is related to the primary purpose which an ordinary person would reasonably expect such information to be used for.
We may also from time to time use that information for purposes of conducting direct marketing to promote our products and services, surveying interest in other products and services, sending invitations to educational or social functions or for purposes of disseminating information which we think may be of interest to our clients and contacts.
If you are an applicant for employment, in addition to the above category of information, we may need to collect other personal information relevant to your application. Should your application be unsuccessful we may retain your information so that we may contact you should another employment opportunity arise.

PERSONAL INFORMATION SECURITY
Beyond Vacations is committed to keeping secure the data you provide us and we will take all reasonable precautions to protect your personal information from interference, loss, misuse, modification or disclosure.
We generally do not contract out data storage or processing functions. If Beyond Vacations does contract out storage or processing of data containing personal information, we will take reasonable steps to ensure the recipient of the information acknowledges the private nature of any personal information disclosed, and that the recipient undertakes to abide by the privacy obligations under the Australian Privacy Principles in respect of any personal information received, subject to any permitted exceptions to those obligations.
It is conceivable that personal information may be disclosed by Beyond Vacations to a business or government agency located in a jurisdiction other than Australia (an overseas recipient) in limited circumstances. We will not disclose personal information to an overseas recipient unless it is necessary for the negotiation or performance of a contract between you and the overseas recipient (or its Australian principal) that we are arranging on your behalf (a booking), or for the negotiation or performance of a contract between us and the overseas recipient that is necessary to give effect to your booking or is otherwise in your interest.
We will endeavour where possible not to deal with overseas recipients unless they have undertaken to comply with Australian Privacy Principles (other than Australian Privacy Principle 1) or we believe they are subject to a law in their jurisdiction that overall is at least substantially similar to the way in which the Australian Privacy Principles protect personal information and enforcement mechanisms are available in the event of a breach of privacy. If these circumstances do not apply then we will not release your personal information unless you expressly consent.
In the course of providing services to customers who are travelling overseas, it is likely that Beyond Vacations will disclose personal information to Australian based travel organisations such as airlines and tour companies (“Australian travel organisations”) who will in turn disclose that information to an overseas recipient. You should be aware that Beyond Vacations holds no responsibility for the treatment of your personal information by that overseas recipient, although the Australian travel organisation to which we provided it will also be bound by the Australian Privacy Principles. Therefore, the Australian travel organisation will be responsible to ensure that the overseas recipient has undertaken to comply with Australian Privacy Principles (other than Australian Privacy Principle 1) or the Australian travel organisation believes the overseas recipient is subject to a law in its jurisdiction that overall is at least substantially similar to the way in which the Australian Privacy Principles protect personal information and enforcement mechanisms are available in the event of a breach of privacy.
Beyond Vacations will retain the personal information for so long as is reasonably necessary for its purposes but we will destroy or permanently remove the identifying features of personal information if it is no longer needed.
ACCESS TO PERSONAL INFORMATION
You can request us to provide access to the personal information that we hold about you.
You may request us to amend the details of the personal information we hold. We will amend the details on request provided we are satisfied that the amendment is valid. We may in some circumstances request you to provide documentary evidence or other corroboration of validity (e.g. provision of a marriage certificate or a registered deed poll to amend your name). If we do not consider it appropriate to make an amendment we will notify you within a reasonable time including written reasons for the refusal.
If we refuse to amend details of any personal information that we hold following a request from you, you may request that we include in our records a statement associated with the applicable information that will make apparent to users of the information that you contest its validity (“a qualifying statement”).
If you consider that Beyond Vacations has wrongly failed to amend its records or not complied with the Australian Privacy Principles in its treatment of your personal information you may lodge a written complaint detailing the grounds of complaint. All complaints received will be considered by a senior manager of the organisation and a written response, including a statement of any remedial action to be taken if appropriate, will be provided to you within a reasonable time.

The below Booking Conditions apply to the person making the booking and all other persons on whose behalf the booking is made.
Please read these Booking Conditions carefully. They apply to all bookings made through Beyond Vacations, who are acting as agents on behalf of all of the suppliers (including airlines, tour and cruise operators, car hirers and accommodation providers) in your booking. You are contracting with the suppliers, whose terms and conditions apply to your booking. Copies of those terms and conditions are available upon request. These booking conditions govern your relationship with Beyond Vacations. The person making the booking must be at least 18 years of age and must be authorised to make the booking on behalf of the members of the party. The person making the booking must also provide a copy of these booking conditions to the other members of the party.
The Contract – After we have received your deposit or full payment (if applicable) and we have issued a confirmation invoice, a contract will exist between you and each of the suppliers, effective from the date printed on your invoice. The terms and conditions of each supplier you have booked with will apply to your booking. Once the contract(s) is made, the airlines, accommodation provider and any other supplier is responsible for providing you with what you have booked.
Agency – Beyond Vacations acts as a travel agent. We arrange travel services and sell travel related products on behalf of suppliers such as airlines, tour and cruise operators, car hirers and accommodation providers. In doing so Beyond Vacations gives no warranty nor makes any representation regarding the services to be supplied or the products purchased by you. Your booking will be subject to the terms and conditions applied by the provider of the service or products. You agree that if the travel services or products are not supplied in accordance with your booking your remedy lies with the service provider and not Beyond Vacations.
Prices – Every effort is made to ensure that the prices quoted to you are correct; however Beyond Vacations acts only as an agent and relies on information provided to us from the suppliers of the travel services and products. We will bring to your attention any change in price made prior to you completing your booking and paying the balance of the price. Please note some tour operators and travel service providers reserve the right to increase the price of your travel arrangements due to increases in airfares, hotel accommodation charges and currency fluctuations.
Airfare Conditions – Many airfares are subject to strict conditions regarding amendments, cancellations and refunds. In addition airlines impose taxes fees and charges. It is your responsibility to ensure the type of airfare you purchase is suitable for your needs.
Airline Taxes and Fuel Surcharges – All airfares are subject to taxes and charges levied by both government and the airlines themselves; in addition global fuel costs are constantly increasing. Airlines pass on the increase in taxes and fuel surcharges without notice and whilst we will endeavour to advise you of these charges in advance that may not always prove possible. Beyond Vacations reserves the right to pass on fuel and tax increases, levied by airlines, without notice.
Airline E-tickets – International and domestic airlines are replacing paper tickets with electronic tickets called e tickets. All passengers travelling on an e ticket will be required to produce photo identification at check in.
Airline Schedules – The airline on which you are booked may change its departure time. It is your responsibility to contact the airline to check there has been no change to the time of departure.
Alterations made by you – If you want to change any part of your booking, we will do all we can to help. However, the suppliers are under no obligation to make any change, although with reasonable notice (usually more than four weeks), changes may be possible. If a supplier is able to make a change, Beyond Vacations will charge an administration fee per booking as set out in the attached schedule of fees.
Cancellation Fees – If you cancel your booking you may incur a cancellation charge. The amount of this charge will vary depending on when the cancellation is made and the terms and conditions of the supplier of travel services or product. If you are entitled to a refund please note Beyond Vacations is unable to provide you with funds until they are received from the supplier. Beyond Vacations will charge a cancellation fee per booking as set out in the attached schedule of fees.
Liability – As Beyond Vacations is only acting as an agent we have no liability in respect of the supply of any element of your booking, including any liability for illness, personal injury, death or loss of any kind, delay and inconvenience caused directly or indirectly by any provider of travel services or products or by other third parties unless caused by our negligence. Any claim for damages for injury, illness, loss or death must be brought against the relevant supplier of the travel services or products. Nothing in these terms and conditions shall be read as excluding, restricting or modifying rights under the Trade Practices Act and other legislation given to consumers in relation to the supply of goods and services.
Force Majeure – Beyond Vacations shall not be liable for any loss or damage incurred by you as a consequence of Beyond Vacations or any of the suppliers being unable to perform its obligations under your contract(s) due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event.
Travel Insurance – Beyond Vacations strongly recommends that you take out comprehensive travel insurance at the time of paying a deposit. The policy should provide cover for loss of deposit, cancellation and additional expenses, medical expenses and repatriation and loss or damage to baggage and valuables. You are responsible for making any special or increased insurance arrangements which you deem are necessary.
Service Fees/Booking Fee – Beyond Vacations may at its discretion charge service fees on your booking. Our service charges are set out in the attached schedule of fees.
Payment by Credit Credit card surcharges may apply to payments made by credit card. In the event you pay by credit card but the services are not provided by a third party provider of travel services or products you agree that you will not take steps to charge back your payment to Beyond Vacations.
Passport and Visas – It is your sole responsibility to ensure you have a valid passport at the time of travelling and that you hold all necessary visas and permits. All Australians must hold a valid passport for international travel. Some countries require you when entering to hold passport with at least six months validity. Australian permanent residents require a valid re-entry permit. Children are required to hold individual passports.
Complaints – We hope you will have no reason to complain but if you are unhappy with any aspect of the services provided you must report it immediately to the supplier, or contact Beyond Vacations. We shall attempt to resolve the matter immediately but if you remain dissatisfied you must write to us within 28 days from the end of your trip or holiday. Failure to complain at your destination may mean we will be unable to resolve the dispute after you return home.
Data Protection – In order to process your booking we need to pass your details to the relevant suppliers. We will take all reasonable precautions to ensure the security of that information. We may also use the information you provide for marketing purposes and, if you do wish to receive any further information, please inform Beyond Vacations.
General – Beyond Vacations reserves the right to alter these terms and conditions at any time.
Governing Law – Your contract with Beyond Vacations is governed by the laws of Victoria and you agree to submit to the jurisdiction of the courts of Victoria to determine any dispute pertaining to the contract. Beyond Vacations acts as an agent on behalf of airlines, tour operators and other service provideers only. Beyond Vacations Pty Ltd accepts all monies paid and commitments given subject to our terms of trade and schedule of fees and those stipulated by other service providers you may use as part of your overall arrangements handled by us. These conditions apply to yourself, your family or travelling companies that you represent or make payments on their behalf. Our professional Beyond Vacations staff(s) will advise and provide you with all the relevant documentation and schedule of fees prior to your financial commitment being made.
